1. INTRODUCTION
WSTĘP
1.1. These General Terms and Conditions (hereinafter "GTC" or "Terms of Service") of the
"MotorsBot" platform define the rules of use of the "MotorsBot" platform, administered by Motorsbot
Prosta Spółka Akcyjna with its registered office in Radom at ul. Kazimierza Pułaskiego 6/10, 26-
600 Radom, entered in the Register of Entrepreneurs of the National Court Register maintained by
the District Court Lublin-Wschód in Lublin with its seat in Świdnik, VI Commercial Division of the
National Court Register under KRS number 0001128768, REGON 529711409, NIP 7963031386
(hereinafter the "Platform Administrator").
Niniejsze ogólne warunki korzystania (regulamin) z platformy „MotorsBot” (dalej „OWK” lub „Regulamin”)
określają zasady korzystania z platformy „MotorsBot”, administrowanej przez Motorsbot Prosta Spółka
Akcyjna z siedzibą w Radomiu przy ul. Kazimierza Pułaskiego 6/10, 26-600 Radom, wpisaną do rejestru
przedsiębiorców Krajowego Rejestru Sądowego, prowadzonego przez Sąd Rejonowy Lublin Wschód w
Lublinie z Siedzibą w Świdniku, VI Wydział Gospodarczy KRS pod numerem KRS 0001128768, REGON
529711409, NIP 7963031386.
1.2. MotorsBot is a technological platform managed by the Platform Administrator, enabling Users
to conclude transactions concerning Vehicles online. The Platform consists of a mobile application
(iOS/Android) dedicated to Buyers (Purchasers) and a web panel dedicated to Sellers (Vendors).
The Platform utilises identity verification (iDent KYC), blockchain technology (Hyperledger Fabric
for transaction records and Polygon for vehicle digital passports), the institution of an optional
Curator, and escrow systems managed by certified external Partners (Trustap Limited and
Transpact).
MotorsBot to platforma technologiczna, zarządzana przez Administratora Platformy, umożliwiająca
Użytkownikom zawieranie transakcji dotyczących Pojazdów online. Platforma składa się z aplikacji
mobilnej (iOS/Android) dedykowanej dla Nabywców (Kupujących) oraz panelu webowego
dedykowanego dla Zbywców (Sprzedających). Platforma wykorzystuje weryfikację tożsamości (iDent
KYC), technologię blockchain (Hyperledger Fabric do zapisu transakcji oraz Polygon do cyfrowych
paszportów pojazdów), instytucję opcjonalnego Kuratora oraz systemy escrow zarządzane przez
certyfikowanych zewnętrznych Partnerów (Trustap Limited i Transpact).
1.3. The GTC defines the rules of use of the Platform, as well as the rights, obligations, and scope
of liability of Users and the Platform Administrator. By taking any actions aimed at using the
Platform or performing any activities within or with the use of the Platform, each User is obliged to
comply with the provisions of these GTC and the Service Regulations. Before commencing use of
the Platform, the User should carefully read the GTC; its acceptance is a condition for creating and
using an Account on the Platform.
OWK określa zasady korzystania z Platformy oraz prawa i obowiązki oraz zakres odpowiedzialności
Użytkowników i Administratora Platformy. Z momentem podjęcia czynności zmierzających do
korzystania z Platformy lub dokonania jakichkolwiek działań w ramach lub z wykorzystaniem Platformy
każdy Użytkownik zobowiązany jest do przestrzegania postanowień OWK oraz Regulaminów Usług.
Przed rozpoczęciem korzystania z Platformy należy uważnie zapoznać się z treścią OWK, a jego
akceptacja jest warunkiem utworzenia i korzystania z Konta na Platformie.
1.4. By using the Platform, the User confirms that they have read the GTC and accepts all its
provisions and undertakes to comply with them. Failure to consent to any of the provisions of the

GTC means a complete inability to use the Platform. All Services offered on the Platform are
provided in accordance with the GTC and the Service Regulations, unless otherwise stipulated.
Korzystając z Platformy Użytkownik potwierdza, że zapoznał się z treścią OWK i akceptuje wszystkie
jego postanowienia oraz zobowiązuje się do przestrzegania jego postanowień. Niewyrażenie zgody na
którekolwiek z postanowień OWK oznacza całkowity brak możliwości korzystania z Platformy.
1.5. The GTC constitutes the terms and conditions for the provision of services referred to in Article
8(1)(1) of the Act on the Provision of Electronic Services, and is also aligned with the requirements
of Regulation (EU) 2016/679 (GDPR), Directive 2011/83/EU on consumer rights, and Regulation
(EU) No 910/2014 (eIDAS) concerning electronic identification and trust services.
OWK stanowi Regulamin świadczenia usług, o którym mowa w art. 8 ust. 1 pkt 1 Ustawy o Świadczeniu
Usług Drogą Elektroniczną, i jest zgodny z wymaganiami Rozporządzenia (UE) 2016/679 (RODO),
Dyrektywy 2011/83/UE w sprawie praw konsumentów oraz Rozporządzenia (UE) nr 910/2014 (eIDAS)
w sprawie identyfikacji elektronicznej i usług zaufania.
1.6. The Platform Administrator is entitled to add, edit, change, and remove any content published
on the Platform, in whole or in part. The name of the Platform, its logo, operating principles, all
graphic elements, interface, as well as the software on which it is based, source code, and
databases are subject to legal protection under the provisions of the Act of 4 February 1994 on
Copyright and Related Rights, the Act of 30 June 2000 on Industrial Property Law, Directive
2001/29/EC on copyright in the information society, and other mandatory provisions of law.
Administrator Platformy jest uprawniony do dodawania, edycji, zmiany i usuwania wszelkich treści
zamieszczanych w Platformie, w całości lub w części. Nazwa Platformy, logo, zasady działania
Platformy, wszystkie jej elementy graficzne, interfejs, a także oprogramowanie, na którym się opiera, kod
strony oraz bazy danych podlegają ochronie prawnej na podstawie przepisów ustawy z dnia 4 lutego
1994 r. o prawie autorskim i prawach pokrewnych, ustawy z dnia 30 czerwca 2000 r. – Prawo własności
przemysłowej, Dyrektywy 2001/29/WE w sprawie prawa autorskiego w społeczeństwie informacyjnym,
oraz innych bezwzględnie obowiązujących przepisów prawa.
2. DEFINITIONS
DEFINICJE
Platform Administrator Administrator Platformy
The entity providing the service of making the Platform available to Users, i.e., Motorsbot Prosta Spółka
Akcyjna with its registered office in Radom at ul. Kazimierza Pułaskiego 6/10, 26-600 Radom, KRS
0001128768, REGON 529711409, NIP 7963031386. Podmiot świadczący usługę udostępniania
Platformy na rzecz Użytkowników, tj. Motorsbot PSA z siedzibą w Radomiu.
Blockchain
Two blockchain networks used by the Platform: (1) Hyperledger Fabric — a private permissioned network
serving as an immutable ledger for the history of activities, transactions, and Agreements concluded on
the Platform; (2) Polygon — a public network used exclusively for recording Digital Product Passports
(DPP) and NFT tokens assigned to Vehicles, at the Vehicle owner's discretion. Dwie sieci blockchain
wykorzystywane przez Platformę: (1) Hyperledger Fabric — prywatna sieć permissioned służąca jako
niezmienny rejestr historii czynności, transakcji i Umów; (2) Polygon — sieć publiczna wykorzystywana
wyłącznie do zapisu Cyfrowych Paszportów Produktowych (DPP) i tokenów NFT, według uznania
właściciela Pojazdu.

A service provided by the Platform Administrator, consisting of providing Platform functionality supporting
Users in the process of using other Platform functionalities, in particular in the process of concluding
Agreements. The Bot uses artificial intelligence systems. Usługa świadczona przez Administratora
Platformy, polegająca na udostępnieniu funkcjonalności Platformy obejmującej wspieranie
Użytkowników w procesie korzystania z Platformy, w szczególności w procesie zawierania Umów.
Buyer (Nabywca)
A User who has concluded an Agreement concerning a Vehicle with a Seller through the Platform. Buyers
use the mobile application (iOS/Android). Użytkownik, który zawarł ze Zbywcą, za pośrednictwem
Platformy, Umowę dotyczącą Pojazdu. Nabywcy korzystają z aplikacji mobilnej.
Curator (Kurator)
An independent natural person, not affiliated with the Platform Administrator, optionally selected by one
or both parties to the Agreement, who verifies the condition of the Vehicle. The Curator's decision
influences the execution of the transaction. Niezależna osoba fizyczna, niezwiązana z Administratorem
Platformy, wybrana opcjonalnie przez jedną lub obie strony Umowy, weryfikująca stan Pojazdu.
DPP (Digital Product Passport)
A digital product passport of the Vehicle that may be recorded on the public Blockchain network (Polygon)
at the Vehicle owner's discretion. Cyfrowy paszport produktowy Pojazdu, który może zostać zapisany na
publicznej sieci Blockchain (Polygon) według uznania właściciela Pojazdu.
Escrow (Trust Account) Rachunek Powierniczy
A secure payment processing service provided by external, authorised providers (Trustap Limited,
registered in Ireland, or Transpact, registered in the United Kingdom), to whose accounts the Buyer
deposits funds securing the Agreement. Usługa bezpiecznego przetwarzania płatności świadczona przez
zewnętrznych, autoryzowanych dostawców (Trustap Limited z siedzibą w Irlandii lub Transpact z
siedzibą w Wielkiej Brytanii).
Escrow Orchestrator Orkiestrator Escrow
A technical function of the Platform consisting solely of transmitting transaction statuses and instructions
for the release/withholding of funds to Escrow Partners, based on the actions of the Parties or the
Curator, without directly holding monetary funds. Techniczna funkcja Platformy polegająca wyłącznie na
przekazywaniu Partnerom Escrow statusów transakcji i dyspozycji zwolnienia/wstrzymania środków.
Firebase / OTP
An authentication system through which one-time SMS passwords (OTP) are used for logging in and
authorising (signing) Agreements on the Platform. System autentykacji, za pomocą którego jednorazowe
hasła SMS (OTP) służą do logowania oraz autoryzacji (podpisywania) Umów na Platformie.
iDent (KYC)
An external User identity verification system (identity document and facial biometrics with liveness
check), constituting a prerequisite for full use of the Platform. Zewnętrzny system weryfikacji tożsamości
Użytkowników (dokument tożsamości oraz biometria twarzy), stanowiący warunek konieczny dla
pełnego korzystania z Platformy.
Consumer (Konsument)
A natural person performing a legal act with an entrepreneur not directly related to their business or
professional activity within the meaning of Article 22(1) of the Civil Code, as well as a natural person
concluding an agreement directly related to their business activity, where the content of said agreement
indicates that it does not have a professional character for such person, pursuant to Article 385(5) of the
Civil Code. For EU cross-border purposes, Consumer shall also be interpreted in accordance with

Directive 2011/83/EU. Osoba fizyczna dokonująca z przedsiębiorcą czynności prawnej niezwiązanej
bezpośrednio z jej działalnością gospodarczą lub zawodową w rozumieniu art. 22(1) Kodeksu Cywilnego.
NFT
A unique digital token assigned to a Vehicle on the public Blockchain network (Polygon), generated at
the Vehicle owner's discretion. Unikalny token cyfrowy przypisany do Pojazdu na publicznej sieci
Blockchain (Polygon), generowany według uznania właściciela Pojazdu.
Smart Contract Number (NSK)
A unique number of the Blockchain register created for a set of data identified by: Buyer ID, Seller ID,
and Vehicle Offer ID. Numer danego rejestru Blockchain tworzony dla zbioru danych identyfikowanych
przez: ID Nabywcy, ID Zbywcy, ID Oferty Pojazdu.
Platform / MotorsBot
conclusion of Agreements between Buyers and Sellers, administered by the Platform Administrator.
zawieranie Umów między Nabywcą i Zbywcą, administrowany przez Administratora Platformy.
Seller (Zbywca)
A User who has concluded an Agreement concerning a Vehicle with a Buyer through the Platform. Sellers
use the web panel (panel.motorsbot.com). Użytkownik, który zawarł z Nabywcą, za pośrednictwem
Platformy, Umowę dotyczącą Pojazdu. Zbywcy korzystają z panelu webowego.
Snapshot
A frozen snapshot of transaction terms generated after the Negotiation process, constituting the basis
for generating the final Agreement. Wygenerowany po procesie Negocjacji zamrożony zrzut warunków
transakcji, stanowiący podstawę do wygenerowania ostatecznej Umowy.
Agreement (Umowa)
Any agreement concluded through or with the use of the Platform. Każda umowa zawarta za
pośrednictwem lub przy wykorzystaniu Platformy.
User (Użytkownik)
Any natural person with full legal capacity, a natural person conducting business activity, and
representatives of legal persons or organisational units without legal personality, who in any way use the
Platform or Services provided on the Platform by the Administrator. Każda osoba fizyczna posiadająca
pełną zdolność do czynności prawnych, osoba fizyczna prowadząca działalność gospodarczą oraz
reprezentanci osób prawnych lub jednostek organizacyjnych, które w jakikolwiek sposób korzystają z
Platformy lub z Usług świadczonych na Platformie.
Vehicle (Pojazd)
A means of transport intended for movement on public roads or other surfaces, powered by an engine
or muscular force. Środek transportu przeznaczony do poruszania się po drogach publicznych lub innych
nawierzchniach, napędzany silnikiem lub siłą mięśni.
Force Majeure Siła Wyższa
Any circumstance independent of the will of the Parties that prevents the performance of contractual
obligations, which cannot be avoided or the effect of which is caused by abnormal, irreversible events
that cannot be foreseen, including: flood, fire, earthquake, war, epidemic, pandemic, sanctions, or states
of emergency introduced by state authorities. Każda okoliczność niezależna od woli Stron

uniemożliwiająca wykonanie zobowiązań umownych, w szczególności: powódź, pożar, trzęsienie ziemi,
wojnę, epidemie, pandemie, sankcje lub stany wyjątkowe.
3. TECHNICAL REQUIREMENTS
WARUNKI TECHNICZNE
3.1. In order to properly use the Services available on the Platform, including effective registration
and login, the following are jointly required: (a) an Internet connection; (b) devices allowing the use
of Internet resources; (c) a web browser supporting JavaScript and accepting cookies; (d) for
Buyers and Sellers registering – an active email account and a mobile phone with an active number
supporting SMS; (e) for Buyers – a mobile device with iOS or Android operating system capable of
installing the MotorsBot mobile application; (f) a device equipped with a webcam or camera for
mandatory identity verification (KYC) via the iDent service.
W celu prawidłowego korzystania z Usług dostępnych w Platformie, w tym skutecznego zarejestrowania
i zalogowania się, niezbędne jest łącznie: (a) połączenie z siecią Internet; (b) posiadanie urządzeń
pozwalających na korzystanie z zasobów sieci Internet; (c) korzystanie z przeglądarki internetowej
obsługującej JavaScript i akceptującej pliki cookies; (d) posiadanie aktywnego konta email oraz telefonu
komórkowego z aktywnym numerem obsługującym SMS; (e) dla Nabywców – posiadanie urządzenia
mobilnego z systemem iOS lub Android; (f) posiadanie urządzenia wyposażonego w kamerę w celu
weryfikacji tożsamości (KYC) za pośrednictwem usługi iDent.
3.2. Within the Platform, it is prohibited for Users to use viruses, bots, worms, or other computer
codes, files, or programmes (in particular scripts automating processes and applications or other
codes, files, or tools).
W ramach Platformy zabronione jest korzystanie przez Użytkowników z wirusów, botów, robaków bądź
innych kodów komputerowych, plików czy programów.
3.3. The Platform Administrator informs that it uses cryptographic protection of electronic transfer
and digital content by applying appropriate logical, organisational, and technical measures,
including TLS/SSL encryption, access passwords, and antivirus programmes.
Administrator Platformy informuje, że wykorzystuje kryptograficzną ochronę transferu elektronicznego
oraz treści cyfrowych przez zastosowanie właściwych środków logicznych, organizacyjnych i
technicznych, w tym szyfrowanie TLS/SSL.
3.4. The Platform Administrator shall endeavour to ensure Platform availability at a level of 99.5%
on a monthly basis, excluding technical breaks, of which Users will be informed with appropriate
advance notice.
Administrator dokłada starań, aby zapewnić dostępność Platformy na poziomie 99,5% w skali miesiąca,
z wyłączeniem przerw technicznych, o których Użytkownicy będą informowani z odpowiednim
wyprzedzeniem.
4. SERVICES PROVIDED ELECTRONICALLY
USŁUGI ŚWIADCZONE DROGĄ ELEKTRONICZNĄ
4.1. Acceptance of the GTC and the Privacy Policy is equivalent to the conclusion of an Account
Service Agreement and other Services described in the GTC or Service Regulations with the
Platform Administrator.
Akceptacja OWK i Polityki prywatności jest równoznaczna z zawarciem z Administratorem Platformy
Umowy o Świadczenie Usługi Konta i innych Usług opisanych w OWK lub Regulaminach Usług.

4.2. Within the Account Service, the Platform Administrator grants Users access to the Platform
and undertakes to maintain it without unnecessary interruptions or downtime.
W ramach Usługi Konta, Administrator Platformy udziela Użytkownikom dostępu do Platformy i
zobowiązuje się do jej utrzymania bez zbędnych przerw lub przestojów.
4.3. The Account Service allows in particular: (a) access to the Platform; (b) browsing current
Vehicle Offers; (c) browsing, reading, and downloading information and materials published by
Sellers; (d) declaring interest in a Seller's Vehicle Offer; (e) concluding Agreements, including with
other Users and Partners; (f) access to integration with external vehicle history registers (e.g.,
CarVertical, CEPiK); (g) electronic conclusion of Agreements (Platform's own signing procedures
with Firebase SMS OTP authorisation); (h) micropayment processing for selected Services via
Stripe integration.
Usługa Konta pozwala w szczególności na: (a) dostęp do Platformy; (b) przeglądanie aktualnych Ofert
Pojazdów; (c) przeglądanie, odczytywanie i pobieranie informacji i materiałów zamieszczonych przez
Zbywców; (d) zgłoszenie deklaracji zainteresowania Ofertą Pojazdu; (e) zawieranie Umów; (f) integrację
z zewnętrznymi rejestrami historii pojazdów (np. CarVertical, CEPiK); (g) elektroniczne zawieranie Umów
(procedury podpisu własne Platformy z autoryzacją SMS OTP Firebase); (h) obsługę mikropłatności
przez Stripe.
5. PLATFORM ADMINISTRATOR DECLARATIONS
OŚWIADCZENIA ADMINISTRATORA PLATFORMY
5.1. The Platform Administrator declares that: (a) the Platform is an online service enabling Sellers
to present their Vehicle Offers to Users; (b) it provides Services to Users electronically within the
meaning of the Act on the Provision of Electronic Services and Directive 2000/31/EC on electronic
commerce; (c) it does not conduct business as a payment institution and does not perform payment
services within the meaning of the Payment Services Act and Directive (EU) 2015/2366 (PSD2).
Administrator Platformy oświadcza, że: (a) Platforma jest serwisem internetowym umożliwiającym
Zbywcom przedstawienie Ofert Pojazdu; (b) świadczy na rzecz Użytkowników Usługi drogą elektroniczną
w rozumieniu Ustawy o Świadczeniu Usług Drogą Elektroniczną oraz Dyrektywy 2000/31/WE; (c) nie
prowadzi działalności jako instytucja płatnicza ani nie wykonuje usług płatniczych w rozumieniu Ustawy
o Usługach Płatniczych oraz Dyrektywy (UE) 2015/2366 (PSD2).
5.2. The Platform Administrator does not mediate in the realisation of Vehicle promotions by
Sellers, by soliciting, accepting orders, accepting monetary funds as payment from Users, or other
intermediation in their acquisition.
Administrator Platformy nie pośredniczy przy realizowaniu przez Zbywców promocji Pojazdów, poprzez
zachęcanie, przyjmowanie zleceń, przyjmowanie środków pieniężnych tytułem zapłaty od Użytkowników
lub inne pośrednictwo w ich nabyciu.
5.3. The Platform Administrator declares that it is not a party to agreements concluded between
Users and Curators, does not charge any commissions or fees for services provided by Curators,
and bears no liability for their actions, omissions, or assessment of the technical condition of the
Vehicle. The Curator's remuneration is settled exclusively outside the Platform.
Administrator Platformy oświadcza, że nie jest stroną umów zawieranych pomiędzy Użytkownikami a
Kuratorami, nie pobiera żadnych prowizji ani opłat z tytułu usług świadczonych przez Kuratorów oraz nie
ponosi odpowiedzialności za ich działania.
5.4. Escrow Orchestration Model: The Platform Administrator does not store, process, or withhold
monetary funds constituting the Agreement Amount. Payments are made exclusively through

licensed providers (Trustap or Transpact). The Administrator acts solely as a technical Orchestrator
transmitting appropriate system instructions.
Model Escrow Orchestration: Administrator Platformy nie przechowuje, nie przetwarza i nie zatrzymuje
środków pieniężnych stanowiących Kwotę Umowy. Płatności realizowane są wyłącznie za
pośrednictwem licencjonowanych dostawców (Trustap lub Transpact). Administrator pełni wyłącznie
funkcję technicznego Orkiestratora.
6. PERSONAL AND BUSINESS PROFILES
PROFIL OSOBISTY I PROFIL FIRMOWY
6.1. A condition for using the Platform by the User is acceptance of the GTC, the Privacy Policy,
and the creation of an Account.
Warunkiem korzystania z Platformy przez Użytkownika jest akceptacja OWK, Polityki prywatności i
założenie Konta.
6.2. To use the Account Service, a natural person (under penalty of inability to create an Account)
must: (a) be at least 18 years of age; (b) declare that they have not been deprived of legal capacity;
(c) create an Account by providing: first name, surname, email address, and mobile phone number;
(d) accept the GTC, its annexes, and the Privacy Policy; (e) successfully complete identity
verification (KYC) via the integrated iDent system (identity document scan and facial liveness
verification).
W celu skorzystania z Usługi Konta osoba fizyczna powinna: (a) posiadać ukończone 18 lat; (b)
oświadczyć, że nie została pozbawiona zdolności do czynności prawnych; (c) założyć Konto poprzez
podanie: imienia, nazwiska, adresu e-mail, numeru telefonu komórkowego; (d) zaakceptować OWK i
Politykę prywatności; (e) pomyślnie przejść weryfikację tożsamości (KYC) za pośrednictwem systemu
iDent.
6.3. Each significant action on the Account, in particular signing an Agreement, requires the
provision of a one-time SMS code (OTP) delivered by the Firebase service.
Każda istotna czynność na Koncie, w szczególności podpisanie Umowy, wymaga podania
jednorazowego kodu SMS (OTP) dostarczanego przez usługę Firebase.
6.4. The Personal Profile shall contain the following mandatory data: first name, surname, email
address, mobile phone number, residential address, PESEL number, nationality, and KYC
verification status (iDent). PESEL is a national identification number and personal data subject to
enhanced protection under Article 87 GDPR. The Platform treats PESEL as restricted-visibility

PESEL stanowi krajowy numer identyfikacyjny oraz dane osobowe podlegające szczególnej ochronie
zgodnie z art. 87 RODO. Platforma traktuje numer PESEL jako dane identyfikacyjne o ograniczonej
widoczności: co do zasady jest on maskowany i dostępny wyłącznie po zaakceptowaniu warunków
transakcji przez obie strony.
6.5. The Business Profile shall contain the following data: NIP number, KRS number (if applicable),
company name, legal form, registered address, REGON (if applicable), names of authorised
signatories, and their email addresses and mobile phone numbers.

6.6. The Account Service Agreement is concluded for an indefinite period and is performed by the
Platform Administrator immediately from the moment of its conclusion.
Umowa o Świadczenie Usługi Konta zostaje zawarta na czas nieoznaczony i jest realizowana
niezwłocznie od chwili jej zawarcia.
7. SELLER PROFILE REGISTRATION
REJESTRACJA PROFILU ZBYWCY
7.1. A condition for the acceptance of a Seller Profile on the Platform is: (a) registration and
completion of the Seller Profile by an authorised representative; (b) registration and completion of
a Personal or Business Profile by each authorised signatory; (c) provision of all required
documents.
Warunkiem akceptacji Profilu Zbywcy jest: (a) zarejestrowanie się na Platformie i wypełnienie Profilu
Zbywcy; (b) zarejestrowanie się i wypełnienie Profilu Osobistego lub Firmowego przez każdego
reprezentanta; (c) dostarczenie wszystkich wymaganych dokumentów.
7.2. The Seller Profile shall include Vehicle Data with the following mandatory documents: (a)
vehicle registration documents – mandatory; (b) document confirming OC (third-party liability)
insurance – mandatory if legally required; (c) other documents such as service history, purchase
agreements, warranties – optional. The Seller may also enter Vehicle data automatically by
scanning the Aztec code from the registration certificate.
Profil Zbywcy zawiera Dane Pojazdu z następującymi obowiązkowymi dokumentami: (a) dokumenty
rejestracyjne Pojazdu – obowiązkowo; (b) dokument potwierdzający ubezpieczenie OC – obowiązkowo,
jeżeli istnieje prawny obowiązek; (c) inne dokumenty jak historia serwisowania, umowy kupna, gwarancje
– opcjonalnie.
8. SELLER DECLARATION CONCERNING THE VEHICLE
OŚWIADCZENIE ZBYWCY DOTYCZĄCE POJAZDU
8.1. The Seller warrants that the data provided by them do not mislead the Platform Administrator,
potential Buyers, Partners, or other Users as to the actual condition of the Vehicle.
Zbywca zapewnia, że dostarczone przez niego dane nie wprowadzają w błąd Administratora Platformy,
potencjalnych Nabywców, Partnerów oraz innych Użytkowników Platformy co do rzeczywistego stanu
Pojazdu.
8.2. The Seller declares that they are the owner of the Vehicle or hold appropriate power of attorney
to sell the Vehicle or otherwise encumber it in accordance with the Agreement, and that they have
the right to use the Vehicle in compliance with applicable laws, including the right to dispose of it.
Furthermore, the Seller declares that the Vehicle is free from any legal encumbrances and third-
party claims.
Zbywca oświadcza, że jest właścicielem Pojazdu lub posiada odpowiednie pełnomocnictwo do
sprzedaży Pojazdu lub innego obciążenia Pojazdu, zgodnie z Umową, oraz że posiada prawo do
korzystania z Pojazdu zgodnie z obowiązującymi przepisami prawa, w tym prawo do jego zbycia.
Ponadto Zbywca oświadcza, że Pojazd jest wolny od jakichkolwiek obciążeń prawnych oraz roszczeń
osób trzecich.

9. PLACING A VEHICLE OFFER ON THE PLATFORM
UMIESZCZENIE OFERTY POJAZDU NA PLATFORMIE
9.1. A condition for publishing a Vehicle Offer on the Platform is the completion by the Seller of the
Vehicle Data and Vehicle Offer data.
Warunkiem opublikowania na Platformie Oferty Pojazdu jest wypełnienie przez Zbywcę Danych Pojazdu
oraz danych Oferty Pojazdu.
9.2. Publication of a Vehicle Offer on the Platform constitutes exclusively an informational
announcement and is treated as an invitation to negotiate within the meaning of Article 71 of the
Civil Code, and not a binding offer of sale.
Publikacja Oferty Pojazdu na Platformie stanowi wyłącznie ogłoszenie o charakterze informacyjnym i
traktowana jest jako zaproszenie do negocjacji w rozumieniu art. 71 Kodeksu cywilnego, a nie wiążąca
oferta sprzedaży.
9.3. Upon publication of the Vehicle Offer, the Vehicle owner may opt to generate a DPP (Digital
Product Passport) and an NFT token assigned to the Vehicle, which are permanently recorded on
the public Blockchain network (Polygon). The Seller acknowledges and consents that the basic
technical data of the Vehicle, including the VIN number, will be elements of a publicly accessible,
unhashed DPP register.
Z chwilą publikacji Oferty Pojazdu, właściciel Pojazdu może zdecydować o wygenerowaniu DPP (cyfrowy
paszport produktowy) oraz token NFT przypisany do Pojazdu, które są trwale zapisywane na publicznej
sieci Blockchain (Polygon). Zbywca przyjmuje do wiadomości i wyraża zgodę na to, że podstawowe dane
techniczne Pojazdu oraz numer VIN będą elementami publicznie dostępnego, niehaszowanego rejestru
DPP.
10. CONCLUSION OF AGREEMENT BY SELLER AND BUYER
ZAWARCIE UMOWY PRZEZ ZBYWCĘ I NABYWCĘ
10.1. The conclusion of an Agreement on the Platform takes place through a Negotiation process,
not through a simple mechanism of accepting a Vehicle Offer.
Zawarcie Umowy na Platformie odbywa się w trybie Negocjacji, a nie poprzez prosty mechanizm
przyjęcia Oferty Pojazdu.
10.2. The Buyer, expressing interest in a Vehicle Offer, initiates the Negotiation process with the
Seller through the built-in messaging module (chat).
Nabywca, wyrażając zainteresowanie Ofertą Pojazdu, inicjuje proces Negocjacji ze Zbywcą za
pośrednictwem wbudowanego modułu wiadomości (czat).
10.3. During Negotiations, the Parties exchange Agreement proposals based on templates. After
agreeing on the final terms (price, specification, Curator identity), the Platform generates a
Snapshot – a frozen capture of the negotiated transaction terms – which becomes the content of
the Agreement.
W toku Negocjacji Strony wymieniają propozycje Umów oparte na szablonach. Po uzgodnieniu
ostatecznych warunków (ceny, specyfikacji, osoby Kuratora), Platforma generuje tzw. Snapshot, czyli
zamrożony zrzut wynegocjowanych warunków transakcji, który staje się treścią Umowy.
10.4. The valid signing of the Agreement generated from the Snapshot by each Party is performed
via the Platform's own electronic signing procedures and requires mandatory authorisation using a

one-time SMS code (OTP) from Firebase, in accordance with eIDAS Regulation (EU) No 910/2014
on electronic identification.

10.5. Upon effective signing of the Agreement by both Parties (status: Signed), all possibilities of

jednostronnej modyfikacji jej warunków przez czat zostają bezpowrotnie zablokowane.
10.6. Payment of the Agreement Amount is then made to a separate Escrow trust account
maintained by an external Partner.
Zapłata Kwoty Umowy dokonywana jest następnie na wyodrębniony rachunek powierniczy Escrow
prowadzony przez zewnętrznego Partnera.
11. CURATOR PARTICIPATION IN THE TRANSACTION
UDZIAŁ KURATORA W TRANSAKCJI
11.1. The Parties to the Agreement have the option of optionally appointing a maximum of two
Curators (one for the Seller, one for the Buyer) to verify the condition of the Vehicle.
Strony Umowy mają możliwość opcjonalnego wyznaczenia maksymalnie dwóch Kuratorów (jeden dla
Zbywcy, jeden dla Nabywcy) w celu weryfikacji stanu Pojazdu.
11.2. A Curator may only be a natural person registered on the Platform with active status, i.e., one
who has successfully completed identity verification (iDent).
Kuratorem może być wyłącznie zarejestrowana na Platformie osoba fizyczna posiadająca status
aktywny, tj. taka, która przeszła pozytywnie weryfikację tożsamości (iDent).
11.3. The Curator's rights within the Platform are limited to reviewing the Snapshot specification
and using the "Accept" or "Reject" function. This decision is recorded on the Blockchain network
and communicated to the Escrow module.
Uprawnienia Kuratora w ramach Platformy ograniczają się do zapoznania się ze specyfikacją ze
Snapshotu oraz użycia funkcji „Akceptuj” lub „Odrzuć”. Decyzja ta rejestrowana jest na sieci Blockchain
i komunikowana do modułu Escrow.
11.4. A change of Curator is possible only until the Agreement status changes to "Signed".
Zmiana Kuratora jest możliwa wyłącznie do momentu zmiany statusu Umowy na „Podpisana”.
11.5. Financial settlements for the Curator's services are conducted entirely outside the Platform.
The Platform Administrator does not accept, process, or bear any liability for payments to the
Curator.
Rozliczenia finansowe z tytułu usług Kuratora odbywają się całkowicie poza Platformą. Administrator
Platformy nie przyjmuje, nie procesuje, ani nie ponosi odpowiedzialności za płatności na rzecz Kuratora.
11.6. If the Curator's verification ends with a "Rejected" status, or one of the Parties raises
objections, the transaction receives the status "Dispute".
W przypadku gdy weryfikacja Kuratora zakończy się statusem „Odrzucono”, lub jedna ze Stron zgłosi
zastrzeżenia, transakcja otrzymuje status „Spór”.

11.7. Upon a Dispute being raised, the Platform suspends the issuance of instructions for the
release of funds from Escrow and notifies the Escrow Partner of the situation.
Z chwilą zgłoszenia Sporu, Platforma wstrzymuje wydanie dyspozycji zwolnienia środków z Escrow i
powiadamia Partnera Escrow o zaistniałej sytuacji.
11.8. The Platform acts solely as an information intermediary. The final resolution of a Dispute and
any refund of funds from the trust account is conducted in accordance with the regulations of the
providers Trustap or Transpact.
Platforma pełni wyłącznie funkcję pośrednika informacyjnego. Ostateczne rozstrzygnięcie Sporu i
ewentualny zwrot środków z rachunku powierniczego odbywa się zgodnie z regulaminami dostawców
Trustap lub Transpact.

13.2. Deposit of the Agreement Amount constitutes a prerequisite for activation of the transaction
(status change to "Active").
Wpłata Kwoty Umowy stanowi warunek konieczny dla aktywacji transakcji (zmiana statusu na
„Aktywna”).
13.3. Release of funds from the Escrow account to the Seller or their return to the Buyer (e.g., in
the event of a negative Curator verification or a dispute) is conducted in accordance with the
regulations of the providers Trustap or Transpact. In the event of a Dispute, the relevant Escrow
provider shall act as the dispute resolution authority in accordance with its own terms and applicable
consumer protection laws.
Zwolnienie środków z konta Escrow na rzecz Zbywcy bądź ich zwrot do Nabywcy (np. w przypadku
negatywnej weryfikacji przez Kuratora lub sporu) odbywa się zgodnie z regulaminami dostawców Trustap
lub Transpact. W przypadku Sporu, odpowiedni dostawca Escrow działa jako organ rozstrzygający spory
zgodnie ze swoimi warunkami i obowiązującymi przepisami o ochronie konsumentów.
13.4. Minor handling fees or fees for additional Platform features may be processed using the Stripe
micropayment service.
Drobne opłaty manipulacyjne lub opłaty za funkcje dodatkowe w Platformie mogą być procesowane za
pomocą usługi mikropłatności Stripe.
13.5. In the event that the Escrow provider applies interest to funds held in the trust account (as
offered by Transpact), such interest shall accrue in accordance with the provider's terms and shall
be disbursed to the relevant party upon release of funds.
W przypadku, gdy dostawca Escrow nalicza odsetki od środków przechowywanych na rachunku
powierniczym (jak oferuje Transpact), odsetki takie naliczane są zgodnie z warunkami dostawcy i

14. BOT – USER SUPPORT USING AI SYSTEMS

14.1. Within the Platform, the Platform Administrator provides Users with the ability to use the Bot,
i.e., a remote User support system in the process of using the Platform, including in the preparation
and completion of Agreements.
W ramach Platformy, Administrator Platformy zapewnia Użytkownikom możliwość korzystania z Bota, tj.
z systemu zdalnego wsparcia Użytkowników w procesie korzystania z Platformy.
14.2. The Platform Administrator declares, and each User acknowledges and accepts, that
suggestions or recommendations provided by the Bot do not constitute any recommendation or
advice, in particular legal advice, and do not replace the User's obligation to consult a given action
with an expert in the relevant field.
Administrator Platformy oświadcza, a każdy Użytkownik przyjmuje do wiadomości i akceptuje, że
podpowiedzi lub rekomendacje udzielone przez Bota nie stanowią żadnej rekomendacji ani porady, w
szczególności porady prawnej.

14.3. The User may not use the Bot to discover the underlying elements of models, algorithms, and
systems. Web scraping, data mining, or extraction methods to extract data from the Bot Service
are prohibited.
Użytkownik nie może używać Bota do wykrywania elementów leżących u podstaw modeli, algorytmów i
systemów. Zabronione jest korzystanie z metod pobierania, zbierania i wyodrębniania danych z Usługi
Bota.
14.4. The Bot's functionalities are limited to supporting the User in the process of using the Platform.
The Bot is not authorised to make any declarations of will on behalf of the User, in particular, the
Bot is not authorised to conclude any Agreement on behalf of the User.
Funkcjonalności Bota ograniczają się do wsparcia Użytkownika w procesie korzystania z Platformy. Bot
nie jest uprawniony do składania jakichkolwiek oświadczeń woli w imieniu Użytkownika, w szczególności

14.5. The Platform Administrator reserves that use of the Bot is solely at the User's risk. All content
generated by the Bot is of an informational nature only and may not be treated as a basis for making
binding decisions. The User bears sole responsibility for decisions made based on suggestions
received from the Bot.
Administrator Platformy zastrzega, że korzystanie z Bota odbywa się wyłącznie na ryzyko Użytkownika.
Wszelkie treści generowane przez Bota mają charakter wyłącznie informacyjny i nie mogą być
traktowane jako podstawa do podejmowania wiążących decyzji.
15. FEES
OPŁATY
15.1. Unless otherwise expressly stated in the Price List, Services provided by the Platform
Administrator to Users are free of charge.
Jeżeli co innego nie wynika wprost z Cennika, Usługi świadczone przez Administratora Platformy na
rzecz Użytkowników mają charakter darmowy.
15.2. The use of Escrow systems (Trustap/Transpact) involves transaction fees. The amount of the
deposit commission (card or bank transfer) charged by the Escrow operator, including any margin
added by the Platform Administrator (Revenue Margin), is presented to the Buyer each time before
the final acceptance of payment.
Wykorzystanie systemów powierniczych Escrow (Trustap/Transpact) wiąże się
z
opłatami
transakcyjnymi. Wysokość prowizji od wpłaty pobieranej przez operatora Escrow, w tym ewentualnej
marży doliczanej przez Administratora Platformy (Revenue Margin), jest każdorazowo prezentowana
Nabywcy przed ostateczną akceptacją płatności.
15.3. The Platform Administrator may change the Price List; however, this shall not apply to
Agreements already concluded and Services whose provision has already commenced, except for
periodically paid Services, to which the new Price List shall apply from the new billing period. Users
shall be notified of any changes at least 14 days in advance.
Administrator Platformy może dokonać zmiany Cennika, przy czym nie będzie miał on zastosowania do
już zawartych Umów i Usług, których świadczenie zostało rozpoczęte, z wyłączeniem Usług opłacanych
okresowo. Użytkownicy będą powiadomieni o zmianach z co najmniej 14-dniowym wyprzedzeniem.
16. ADDITIONAL SERVICES AND PARTNER SERVICES

16.1. Through the Platform, Agreements concerning Partner Services may also be concluded.
Partner Services are regulated in separate Service Regulations, to which the GTC applies in
matters not regulated therein.
Za pośrednictwem Platformy mogą być również zawierane Umowy dot. świadczenia Usług Partnerów.
Usługi Partnerów regulowane są w odrębnych Regulaminach Usług, do których OWK stosuje się w
kwestiach tam nieuregulowanych.
17. PERSONAL DATA
DANE OSOBOWE
17.1. Personal data of Users is processed by the Platform Administrator in accordance with the
principles set out in the Platform Privacy Policy, Regulation (EU) 2016/679 (GDPR), and applicable
Polish data protection legislation (RODO). The legal bases for processing include: (a) Article 6(1)(b)
GDPR – performance of a contract (Account Service, Agreements); (b) Article 6(1)(c) GDPR –
compliance with legal obligations (AML/KYC, tax regulations); (c) Article 6(1)(f) GDPR – legitimate
interests of the Administrator (fraud prevention, platform security, analytics); (d) Article 6(1)(a)
GDPR – consent (marketing communications, optional data sharing with Partners).
Dane osobowe Użytkowników przetwarzane są przez Administratora Platformy na zasadach określonych
w Polityce prywatności Platformy, Rozporządzeniu (UE) 2016/679 (RODO) oraz obowiązujących
polskich przepisach o ochronie danych osobowych. Podstawy prawne przetwarzania obejmują: (a) art.
6 ust. 1 lit. b RODO – wykonanie umowy; (b) art. 6 ust. 1 lit. c RODO – obowiązek prawny; (c) art. 6 ust.
1 lit. f RODO – prawnie uzasadniony interes; (d) art. 6 ust. 1 lit. a RODO – zgoda.
17.2. In the context of Escrow services, only transaction identifiers and contract links are
transmitted to Escrow providers. Full personal data (name, surname, PESEL, document numbers,
NIP) are NOT transmitted to the Escrow provider and are stored exclusively in the MotorsBot
system.
W kontekście usług Escrow, do dostawców Escrow przekazywane są jedynie identyfikatory transakcji i
linki do kontraktów. Pełne dane osobowe (imię, nazwisko, PESEL, numery dokumentów, NIP) NIE są
przesyłane do dostawcy Escrow i są przechowywane wyłącznie w systemie MotorsBot.
18. WITHDRAWAL FROM THE AGREEMENT – FOR CONSUMERS
ODSTĄPIENIE OD UMOWY – DLA KONSUMENTÓW
18.1. A User who is a Consumer and who has concluded an Account Agreement with the Platform
Administrator has the right to withdraw from the Account Agreement without giving reasons within
14 days from the date of its conclusion, in accordance with Article 27 of the Polish Consumer Rights
Act implementing Directive 2011/83/EU. The withdrawal results in the Agreement being considered
as not concluded. To meet the deadline, the Consumer must send an appropriate withdrawal
statement to the email address: platform@motorsbot.com before the expiry of the specified
deadline. The withdrawal form template constitutes Annex 1 to the GTC.
Użytkownik będący Konsumentem, który zawarł Umowę Konta z Administratorem Platformy, ma prawo
odstąpić od Umowy Konta bez podania przyczyny w terminie 14 dni od daty jej zawarcia, zgodnie z art.
27 ustawy o prawach konsumenta implementującej Dyrektywę 2011/83/UE. Skutkiem odstąpienia od
Umowy Konta jest uznanie jej za niezawartą. Wzór oświadczenia o odstąpieniu stanowi załącznik nr 1
do OWK.

19. COMPLAINTS
REKLAMACJE
19.1. Each User is entitled to file a complaint regarding matters related to the functioning of the
Platform and the performance of Services by the Platform Administrator.
Każdemu Użytkownikowi przysługuje prawo do złożenia reklamacji w sprawach związanych z
funkcjonowaniem Platformy oraz wykonaniem Usług.
19.2. Complaints should be submitted electronically to platform@motorsbot.com or in writing to the
Platform Administrator's address.
Reklamacje należy składać drogą elektroniczną na adres platform@motorsbot.com lub w formie
pisemnej na adres Administratora Platformy.
19.3. Complaints from Consumers shall be considered without undue delay, but no later than within
14 days from the date of their receipt, in accordance with Directive 2013/11/EU on alternative
dispute resolution. Other complaints shall be considered within 30 days from receipt.

20. ACCOUNT DELETION, TERMINATION, AND DISSOLUTION
USUNIĘCIE KONTA, WYPOWIEDZENIE I ROZWIĄZANIE UMOWY
20.1. The Account Service Agreement is dissolved upon deletion of the User's Account.
Umowa o Świadczenie Usługi Konta ulega rozwiązaniu z chwilą usunięcia Konta Użytkownika.
20.2. Account deletion is possible by contacting the Platform Administrator via email to
platform@motorsbot.com. However, where a User is a creator of documents generated through
the Platform or a party to an Agreement that is still active on the Platform, deletion of their Account
is not possible.
Usunięcie Konta jest możliwe poprzez kontakt z Administratorem Platformy drogą e-mail na adres
platform@motorsbot.com. Jednakże w przypadku, gdy Użytkownik jest twórcą dokumentów
generowanych za pomocą Platformy lub stroną aktywnej Umowy, usunięcie jego Konta nie jest możliwe.
20.3. The Platform Administrator may terminate the Account Service Agreement with a User, i.e.,
block or delete their Account, in the event of a breach of the GTC or applicable law, after prior
notice and a 7-day notice period.
Administrator Platformy może rozwiązać Umowę o Świadczenie Usługi Konta z Użytkownikiem, tj.
zablokować lub usunąć jego Konto, w przypadku naruszenia OWK lub obowiązujących przepisów prawa,
po uprzednim wezwaniu, z zachowaniem siedmiodniowego okresu wypowiedzenia.
20.4. Deletion of an Account does not release the User from the obligation to fulfil any obligations
towards the Platform Administrator, Seller, Buyer, or third parties arising in connection with the use
of the Platform or concluded Agreements.
Usunięcie Konta nie zwalnia Użytkownika z obowiązku wywiązania się ze wszelkich ewentualnych
zobowiązań wobec Administratora Platformy, Zbywcy, Nabywcy lub osób trzecich.

21.1. The Platform Administrator does not assess the financial capacity of the Buyer or Seller. The
Platform only collects and makes available information provided by Sellers, subject to the
reservation that such information is not verified, in particular the information concerning the
technical condition of the Vehicle or creditworthiness assessment of the Buyer.
Administrator Platformy nie bada zdolności finansowej Nabywcy ani Zbywcy. Platforma jedynie gromadzi
i udostępnia informacje przekazane przez Zbywców, z zastrzeżeniem, że nie podlegają one weryfikacji.
21.2. Each potential Buyer bears the risk associated with the purchase of a Vehicle and should
independently verify the Vehicle Offer and the associated risks.
Każdy potencjalny Nabywca ponosi ryzyko związane z zakupem Pojazdu i powinien dokonać
samodzielnie weryfikacji Oferty Pojazdu.
21.3. The Platform Administrator bears no liability for any damage arising from decisions or expert
opinions issued by Curators. The Buyer appointing a Curator bears full risk associated with the
adequacy and reliability of their assessment.
Administrator Platformy nie ponosi żadnej odpowiedzialności z tytułu ewentualnych szkód wynikających
z decyzji lub ekspertyz wydanych przez Kuratorów.
22. PLATFORM ADMINISTRATOR LIABILITY
ODPOWIEDZIALNOŚĆ ADMINISTRATORA PLATFORMY
22.1. To the maximum extent permitted by law, the Platform Administrator shall not be liable for
disruptions in the proper functioning of the Platform, as well as loss of data resulting from Force
Majeure, unauthorised actions of third parties, or the Platform Administrator's actions aimed at
improving Platform functionality, unless intentional fault can be attributed to them.

odpowiedzialności za zakłócenia w prawidłowym funkcjonowaniu Platformy, a także utratę danych

mu przypisać winę umyślną.
22.2. To the maximum extent permitted by law, the Platform Administrator shall not be liable for
any damages to third parties directly or indirectly related to the use of Services by Users, unless
intentional fault can be attributed to them.

odpowiedzialności za jakiekolwiek szkody osób trzecich bezpośrednio lub pośrednio związane z

22.3. To the maximum extent permitted by law, the Platform Administrator shall not be liable for
lost profits of Users directly or indirectly related to the use of Services.

odpowiedzialności za utracone korzyści Użytkowników.
22.4. The Platform Administrator shall not be liable for information or documents concerning the
Seller made available on the Platform, as well as for any actions and omissions of the Seller and
third parties, in particular where Vehicle Data are not consistent with the actual or legal state.
Administrator Platformy nie ponosi odpowiedzialności za informacje lub dokumenty dotyczące Zbywcy
udostępnione na Platformie oraz za wszelkie działania i zaniechania Zbywcy i osób trzecich.
22.5. In relations with Users who are not Consumers, the Platform Administrator's liability for lost
profits is entirely excluded, and the total compensatory liability from any title is limited to the amount

of fees and commissions actually paid by the given User to the Administrator in the 12 months
preceding the event giving rise to the damage. This limitation shall not apply to Consumers, whose
rights under mandatory EU and Polish consumer protection law remain unaffected.
W relacjach z Użytkownikami niebędącymi Konsumentami, odpowiedzialność Administratora Platformy
z tytułu utraconych korzyści jest całkowicie wyłączona, a łączna odpowiedzialność odszkodowawcza
ograniczona jest do wysokości opłat faktycznie uiszczonych w okresie 12 miesięcy. Ograniczenie to nie
dotyczy Konsumentów, których prawa wynikające z bezwzględnie obowiązujących przepisów o ochronie
konsumentów pozostają nienaruszone.
22.6. If any provision of these GTC would lead to a limitation of the rights of a Consumer arising
from mandatory provisions of law, the application of which in relations with a Consumer cannot be
limited or excluded, such provisions of the GTC shall not apply to the User who is a Consumer.
This is without prejudice to the consumer's rights under Directive 2011/83/EU and Directive
93/13/EEC on unfair contract terms.
Jeśli jakiekolwiek z postanowień niniejszego OWK prowadziłoby do ograniczenia praw Konsumenta
przysługujących mu na podstawie bezwzględnie obowiązujących przepisów prawa – w stosunku do
Użytkownika będącego Konsumentem tych postanowień OWK nie stosuje się. Nie narusza to praw
konsumenta wynikających z Dyrektywy 2011/83/UE oraz Dyrektywy 93/13/EWG.
23. USER LIABILITY
ODPOWIEDZIALNOŚĆ UŻYTKOWNIKA
23.1. The Seller undertakes to publish complete, exhaustive, and up-to-date information about the
Vehicle on the Platform.
Zbywca zobowiązuje się do umieszczenia na Platformie pełnych, wyczerpujących i aktualnych informacji
na temat Pojazdu.
23.2. The Seller is liable for the truthfulness and currentness of the content and declarations made
in the Vehicle Offer.
Zbywca odpowiada za prawdziwość i aktualność treści i oświadczeń złożonych we Ofercie Pojazdu.
23.3. In the event of third-party claims against the Platform Administrator in connection with the
untruthfulness or outdatedness of any content, data, or declarations of the User, or infringement of
copyright, the User is obliged to immediately join the proceedings in place of or alongside the
Platform Administrator and reimburse all related costs.
W przypadku wystąpienia z roszczeniami w stosunku do Administratora Platformy przez osoby trzecie,
Użytkownik zobowiązany jest niezwłocznie wstąpić do sprawy w miejsce Administratora Platformy i
zwrócić wszelkie związane z tym wydatki.
23.4. Users bear full liability for violations of applicable law or damage caused to the Platform
Administrator, in particular by providing false data, violating personal rights, or intellectual property
rights of third parties.
Użytkownicy ponoszą pełną odpowiedzialność za naruszenia obowiązującego prawa lub szkodę
wyrządzoną Administratorowi Platformy, w szczególności przez podanie nieprawdziwych danych,
naruszenie dóbr osobistych lub praw własności intelektualnej osób trzecich.
24. SMART CONTRACT AND BLOCKCHAIN SERVICES

24.1. Agreement data and all amendments thereto are recorded in the form of Smart Contracts,
the records of which in the form of files are deposited on the Hyperledger Fabric blockchain network
maintained by the Platform Administrator.
Dane Umowy oraz wszelkie do niej zmiany zostają zapisane w formie Smart Kontraktu, których zapis w
formie plików są deponowane w sieci Hyperledger Fabric utrzymywanej przez Administratora Platformy.
24.2. Each addition of a new link to a unique Smart Contract containing new data occurs after
agreement by the Parties to the Agreement on the Platform and approval by the Platform
Administrator.
Każde dodanie nowego ogniwa do unikatowego Smart Kontraktu zawierającego nowe dane następuje
po uzgodnieniu ich najprierw przez Strony Umowy na Platformie i zaakceptowaniu przez Administratora
Platformy.
24.3. The Platform Administrator does not adjudicate disputes between the Buyer and the Seller.
In the event of a dispute or inconsistency of findings, the Platform Administrator may, upon request
of either party or a competent authority, deliver evidence and records saved on the Platform,
including the chronology of block records on the Blockchain network, to assist in establishing the
factual state of relations between Users.
Administrator Platformy nie rozstrzyga sporów między Nabywcą a Zbywcą. W przypadku sporu lub
niezgodności ustaleń, Administrator Platformy może, na wniosek którejkolwiek ze stron lub właściwego
organu, udostępnić dowody i zapisy zgromadzone na Platformie, w tym chronologię zapisu bloków w
sieci Blockchain, w celu ustalenia stanu faktycznego relacji między Użytkownikami.
24.4. The Platform Administrator has read-only access to the block records on the Blockchain
network and does not have the right or ability to edit and change previously recorded blocks on the
Blockchain.
Administrator Platformy posiada jedynie wgląd do zapisu bloków w sieci Blockchain, nie posiada prawa
i możliwości do edycji i zmiany zapisanych wcześniej bloków.
24.5. The Platform performs automatic, periodic reconciliation of data collected in the database
with records on the Blockchain network. In the event of discrepancies being detected, Users will be
informed through dedicated communication channels (email, SMS).
Platforma przeprowadza automatyczną, cykliczną rekoncyliację danych zebranych w bazie danych z
zapisami na sieci Blockchain. W przypadku wykrycia rozbieżności, Użytkownicy zostaną poinformowani
dedykowanymi kanałami komunikacji.
25. FINAL PROVISIONS
POSTANOWIENIA KOŃCOWE
25.1. The Platform Administrator reserves the right to make changes to the GTC and annexes. All
changes shall be displayed on the Platform at least 14 days before the effective date. Users shall
also be notified by email at least 14 days in advance. Within 30 days from the effective date of the
amended GTC, Users are entitled to submit a statement of non-acceptance, which shall be
equivalent to termination of the Account Service Agreement.
Administrator Platformy zastrzega sobie prawo do dokonywania zmian w OWK oraz w załącznikach.
Wszelkie zmiany zostaną uwidocznione na Platformie z co najmniej 14-dniowym wyprzedzeniem.
Użytkownicy zostaną powiadomieni również pocztą elektroniczną. W terminie 30 dni od dnia wejścia w
życie zmienionego OWK, Użytkownicy są uprawnieni do złożenia oświadczenia o braku akceptacji.

25.2. A User who is a Consumer may use out-of-court complaint and claim resolution methods,
with Regulation (EU) No 524/2013. Detailed information is available from municipal consumer
ombudsmen, consumer organisations, and the Office of Competition and Consumer Protection
(www.uokik.gov.pl).
Użytkownik będący Konsumentem może skorzystać z pozasądowych sposobów rozpatrywania
reklamacji i dochodzenia roszczeń, w tym za pośrednictwem platformy ODR dostępnej pod adresem
25.3. In matters related to the functioning of the Platform, including any claims, the applicable law
is Polish law, subject to mandatory provisions of EU law, including Regulation (EU) 2016/679
(GDPR), Directive 2011/83/EU (Consumer Rights), and Regulation (EU) No 910/2014 (eIDAS).
W kwestiach związanych z funkcjonowaniem Platformy prawem właściwym jest prawo polskie, z
zastrzeżeniem bezwzględnie obowiązujących przepisów prawa UE, w tym RODO, Dyrektywy
2011/83/UE i Rozporządzenia eIDAS.
25.4. The court competent for disputes between the User who is not a Consumer and the Platform
Administrator shall be the court having jurisdiction over the city of Warsaw, Śródmieście district.
For Consumers, jurisdiction shall be determined in accordance with applicable law, including
Regulation (EU) No 1215/2012 (Brussels I bis).
Sądem właściwym w stosunkach między Użytkownikiem niebędącym Konsumentem a Administratorem
Platformy jest sąd właściwy dla m.st. Warszawy, dzielnica Śródmieście. Dla Konsumentów właściwość
sądu określana jest zgodnie z obowiązującymi przepisami, w tym Rozporządzeniem (UE) nr 1215/2012
(Bruksela I bis).
25.5. If any provision of the GTC proves to be legally ineffective or invalid in whole or in part, this
does not affect the validity and binding force of the remaining provisions of the GTC.
Jeżeli któreś z postanowień OWK okaże się prawnie nieskuteczne lub nieważne w całości lub w części,
nie narusza to ważności i mocy obowiązującej pozostałych postanowień OWK.
25.6. This version of the GTC takes effect on 1 May 2026.
Niniejsza wersja OWK wchodzi w życie z dniem 1 maja 2026 r.
